Terms of Service

These terms govern the use of the CRM service (the "Service") provided by Инсиде Кафе ДООЕЛ, tax number 4020010509977, company registration number 6562418, registered at Бул. Македонски Просветители л. 12, Охрид (the "Provider"). By creating an account, requesting a trial or paying for a subscription, the legal entity using the Service (the "Customer") accepts these terms.
1. The Service
The Service is software for customer relationship management, invoicing, support and other business modules, delivered over the internet. Each Customer has its own separate database. The modules available to the Customer depend on the chosen package.
The Service is intended for legal entities and persons carrying on a business. The Customer declares that it uses the Service for its business and not as a consumer.
2. Account and access
- The Customer is responsible for the accuracy of the information given at registration and for keeping its users' passwords and two-factor authentication codes safe.
- The Customer decides who has access to its account and with which permissions. Every action taken with the Customer's credentials is deemed an action of the Customer.
- The Customer notifies the Provider without delay if it suspects unauthorised access to the account.
3. Trial
The Provider may offer a free trial with the duration and modules set in the package. When the trial ends, access is closed until the Customer chooses a paid package. Data entered during the trial is kept as described in section 9.
4. Packages, prices and payment
- Price, currency, period length, payment terms and modules are set by the package the Customer chose or by a separate agreement with the Provider. The agreed price and terms apply to the current paid period and do not change with later changes to the price list.
- The Provider invoices each period in advance. An invoice is payable by its due date, by bank transfer to the Provider's account or by payment card.
- Card payments are processed by Casys through the cPay payment system. The Provider neither receives nor stores payment card data.
- A change to a higher package takes effect immediately and the new price applies from the next invoice. A change to a lower package takes effect at the end of the current paid period.
5. Late payment and suspension
If an invoice is not paid by its due date, the Provider may notify the Customer. If it remains unpaid for the number of days set in the package, access to the Service may be suspended. Suspension does not delete the Customer's data. Access is restored when the amount due is paid.
6. Cancellation
The Customer may cancel the subscription at any time. Cancellation takes effect at the end of the current paid period, and access stays open until then. Until that moment the cancellation can be withdrawn.
7. Refunds
- A paid period is not refunded when the Customer cancels before it ends.
- The Provider refunds a duplicate payment, a payment for a cancelled invoice, a wrong amount, or a period in which the Service was unavailable for an extended time through the Provider's fault.
- Refunds are made the way the payment was made: card payments through cPay, bank transfers to the account they came from. Refund requests go to info@inside.com.mk. The Provider responds within 8 working days.
8. Customer data
- Data the Customer enters into the Service remains the Customer's property. The Provider processes it only to provide the Service, under the Data Processing Agreement, which forms part of these terms.
- The Customer may export its data from the Service at any time.
- The Customer is responsible for the lawfulness of the data it enters, including the legal basis for processing personal data of its customers, employees and other persons.
9. Termination and deletion of data
After the subscription ends, the Customer may export its data within 30 days. After that period the Provider deletes the Customer's database. Backups are deleted when their retention period of 14 days expires.
10. Availability and backups
The Provider takes reasonable measures to keep the Service available, but does not guarantee uninterrupted availability. Planned maintenance is carried out outside business hours where possible. The Provider makes daily database backups and keeps copies at a separate location.
11. Acceptable use
The Customer will not use the Service for unlawful purposes, to send unsolicited messages, to transmit malicious code, or to attempt unauthorised access to other customers' accounts or to the Provider's systems. The Provider may suspend access immediately in case of such a breach.
12. Intellectual property
The software, its design and documentation belong to the Provider. The Customer receives a non-exclusive, non-transferable right to use the Service for the duration of the subscription.
13. Liability
The Provider is not liable for indirect damage, lost profit or loss of data caused by actions of the Customer or its users. The Provider's total liability under these terms is limited to the amount the Customer paid for the Service in the preceding 12 months, except in case of intent or gross negligence.
14. Changes to these terms
The Provider may change these terms. The Customer is notified by email of material changes at least 15 days before they take effect. A Customer who does not agree may cancel under section 6.
15. Governing law and disputes
These terms are governed by the law of the Republic of North Macedonia. Disputes that cannot be settled amicably are decided by the competent court in Ohrid.
